The City of Marina, like most cities in California, imposes a Transient Occupancy Tax.  Such taxes are commonly known as “Hotel Taxes.” 

The tax is paid only by hotel guests who spend 29 consecutive days or less in a hotel in the City.  The tax is on the rent paid for each room.  The tax is collected by the hotel operator and remitted to the City of Marina.  The rate of the tax is currently 12% of the rent charged.  For purposes of this tax, a hotel is a structure or lodging, or any portion of any structure or lodging, which is occupied or intended or designed for use or occupancy by transients.   

If Measure P is approved by the voters, the rate of the tax will increase to 14% of the rent charged.  Thus, a hotel guest who incurs hotel rents of $100 per night would pay $14 in taxes per night instead of the current $12 in taxes per night. 

The City currently receives approximately $3.2 Million annually from the transient occupancy tax.  If the rate increase is approved, the City’s tax proceeds would increase to approximately $3.733 Million annually.  

Revenue generated by the transient occupancy tax has been, and will continue to be, deposited in the City’s general fund, which means that the money may be used by the City for any general governmental purpose.  Examples of such uses include fire, police, and road repair and maintenance.    

A “YES” vote is a vote to enact an ordinance increasing the transient occupancy tax rate to 14%.  A “NO” vote is a vote to reject the ordinance, and therefore leave the tax rate at 12%. 

Measure P will be approved if it received a majority vote of those casting ballots on the measure.  Measure P was placed on the ballot by a petition signed by the requisite number of voters.

Argumento A FAVOR

This measure was placed on the ballot via the citizens’ initiative process whereby dozens of Marina residents collected signatures from their neighbors to bring you three much needed measures to provide Marina with the money that it needs to maintain and improve city services affecting our quality of life. In addition to this measure, this citizen group also qualified for the ballot a temporary •••% sales tax and a cannabis tax. We encourage you to vote for all three measures. 

Tourism adds wear and tear to our roads, increases calls for service to our police and fire departments, and increases usage of our other community services. Tourists staying in short-term rentals, such as AirBnB, keep houses off the rental market, increasing the cost of housing for all of us. Tourists should pay their fair share when they stay in Marina hotels and short-term rentals. With this measure, a tourist staying in a $100 per night hotel room will pay $14 in tax instead of $12. This is still a bargain since Marina hotels cost significantly less than hotels closer to Monterey.

This 2% increase in the hotel tax will generate approximately $530,000 per year. Nearly 100% of all revenue generated will come from tourists. Marina residents deserve quality city services including: Safewell-maintained roads; Fully staffed fire and police force; Beautiful parks; and Recreation programs for youth, families, and seniors. With this sales tax revenue Marina will be better positioned to support removal of abandoned buildings and blight aroundthe High School, protect our drinking water, improve access to our beaches, improve the safety of walking and biking, enhance our downtown to attract and retain business, and address regional challenges of affordable housing and traffic congestion. This revenue measure is essential to fund these important public services.

AN ORDINANCE OF THE PEOPLE OF THE CITY OF MARINA

INCREASE IN THE CITY'S TRANSIENT OCCUPANCY TAX RATE FROM TWELVE PERCENT (12%) APPROVED BY THE VOTERS ON NOVEMBER 4, 2014 AND SETTING THE TAX RATE AT FOURTEEN PERCENT (14%), TO CONTINUE PRESERVING FUNDS FOR GENERAL CITY SERVICES

THE PEOPLE OF THE CITY OF MARINA DO HEREBY ORDAIN AS FOLLOWS:

 

Section 1. Amendment. Section 3.12.030 of the City of Marina Municipal Code is hereby amended to read as follows:

3.12.030 Tax Imposed

For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of fourteen percent (14%) of the rent charged by the operator or otherwise payable by the transient. Insofar as the transient is concerned, said tax constitutes a debt owed by the transient to the city which is extinguished only by payment to the operator or to the city. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. For purposes of this section, the rent deemed payable on account of time-share occupancy by a transient shall be the rental value of the unit or room(s) which accommodated such occupancy, which rental value shall be computed by determining the pro rata share of the total actual purchase price of the time-share right or entitlement (whether or not involving any estate or any ownership in real property), or if the unit has not yet been sold at the time of rental, then the pro rata share of the current listed sales price or the comparable price if not listed for sale, which share is allocable to the period of transient occupancy currently involved, and adding thereto the total applicable operating costs including, but not limited to, the applicable real and personal property taxes, plus the total amount of any and all fees, assessments, charges and expenses (not including the previously referred to taxes) charged by the operator as attributable to the time-share occupancy of the transient by whatever name such fees, assessments, charges or expenses may be denominated, whether "occupying fee," "maintenance or operations charge," "per diem fee,” "management fee" or like name or otherwise. In making the computation referred to above of the pro rata share of the total purchase price or other applicable price, in any case wherein the time-share right or entitlement is in perpetuity or for life or otherwise not for a definite or ascertainable term, such proration shall be made upon an assumed term of thirty years. Section 2. Approval by the Voters. This Ordinance shall be submitted to the voters at an election to be held on November 6, 2018 and shall not be effective until so approved.

Section 3. Effective Date. This Ordinance shall go into effect on the first day of the first month following the certification of the vote of the November 6, 2018 election.

Section 4. Severability. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, the remainder of the Ordinance and the application of such provision to other persons or circumstances shall not be affected thereby.

Section 5. Certification. Upon approval by the voters, the Deputy City Clerk shall certify the passage of this Ordinance; and within fifteen days the Deputy City Clerk shall cause it to be posted in the three (3) public places designated by the City Council.
